ПЕРЕВАГИ ЗАКОНУ
регулювання сфери азартних ігор здійснюється єдиним законом;
запровадження електронної системи державного моніторингу, що буде забезпечувати контроль в режимі реального часу за діяльністю у сфері азартних ігор, зареєстровані ставки, виплачені виграші (призи), зроблені виплати, форму розрахунків з гравцями;
запровадження базового принципу організації та проведення азартних ігор «відповідальна гра», який передбачає здійснення організаторами азартних ігор заходів щодо попередження та мінімізації негативних наслідків від участі фізичної особи в азартній грі;
регулювання діяльності з проведення азартних ігор в мережі Інтернет, ліцензування такої діяльності;
створюються умови для розвитку туристичного та готельного бізнесу в Україні
ОСНОВНІ ВИМОГИ
Організатором азартних ігор може бути виключно юридична особа (для всіх юросіб єдині вимоги):
1.створена у формі господарського товариства, яке засноване та провадить діяльність на території України в установленому законом порядку;
2.розмір статутного (складеного) капіталу якої дорівнює або перевищує суму, еквівалентну 2 000 000 (два мільйони) євро на дату видачі організатору азартних ігор ліцензії;
3.статутний (складений) капітал якої сформовано виключно грошовими коштами. Статутний (складений) капітал не може бути сформовано бюджетними коштами, або коштами, залученими у кредит (позику) чи під заставу
ЗАГАЛЬНА ІНФОРМАЦІЯ
На території України дозволяється організовувати та проводити виключно такі види діяльності:
організація та проведення букмекерської діяльності;
організація та проведення азартних ігор казино;
випуск та проведення лотерей. Державне регулювання діяльності у сфері організації і проведення азартних ігор здійснюється Верховною Радою України, Кабінетом Міністрів України, центральним органом виконавчої влади, що забезпечує формування та реалізує державну фінансову політику, Уповноваженим органом, центральним органом виконавчої влади, що забезпечує формування та реалізує державну податкову і митну політику, іншими органами виконавчої влади відповідно до їх повноважень. Національна служба у сфері азартних ігор є центральним органом виконавчої влади, який реалізує державну політику у сфері організації і проведення азартних ігор, діяльність якого спрямовується і координується Кабінетом Міністрів України через Міністра фінансів України (далі – Уповноважений орган)- Уповноважений орган утворюється Кабінетом Міністрів України.
Регулювання ринку лотерей базується на наступних принципах:
принцип єдиного оператора, який визначається на конкурентних засадах;
застосування міжнародних стандартів для розвитку лотерейної галузі в Україні;
забезпечення гарантій застосування принципу відповідальної гри в Україні;
створення умов для залучення інвестицій в Україну. Ліцензія на випуск та проведення лотерей видається за результатами конкурсу, що проводиться Уповноваженим органом, в порядку передбаченому цим законом. Умови проведення конкурсу встановлюються Уповноваженим органом. До участі в конкурсі допускаються юридичні особи, які відповідають таким вимогам:
провадження протягом не менш як п’яти років до подання заяви діяльності з випуску та/або проведення лотерей;
наявність міжнародного досвіду з випуску та/або проведення лотерей не менше ніж в трьох іноземних державах;
загальний оборот за 5 (п'ять) фінансових років, що передують проведенню конкурсу, становить не менше 3 000 000 000 (трьох мільярдів) євро. Оператор лотерей має право надати іншій особі (суб-ліцензіату), що відповідає вимогам передбаченим цим Законом, право проводити окремі лотереї з обов’язковим підключенням суб-ліцензіата до електронної системи прийняття ставок. Розмір плати за ліцензію на випуск та проведення лотерей, та порядок її оплати встановлюється за результатами конкурсу. Ліцензія на випуск та проведення лотерей видається Уповноваженим органом строком на 10 (десять) років.
ЛОТЕРЕЙНА ДІЯЛЬНІСТЬ
ДІЯЛЬНІСТЬ КАЗИНО
Організація та проведення азартних ігор у гральних закладах казино дозволяється виключно у спеціальних гральних зонах. Територією спеціальної гральної зони вважаються:
територія будівель, в яких розташовані готелі категорії «чотири зірки» або «п’ять зірок», з номерним фондом не менше 200 (двохсот) номерів в місті Києві та не менше 100 (ста) номерів в усіх інших населених пунктах та поза межами населених пунктів;
місце чекання пасажирами в контрольованій зоні будівель міжнародних аеропортів. Організатор казино забезпечує розміщення грального обладнання (чіткі вимоги до кількості гральних столів та чисельності співробітників). Законом визначена фіксована вартість за кожний стіл чи гральний автомат. Щорічна вартість ліцензії:
1 000 000 (одному мільйону) євро за офіційним курсом Національного банку України на день сплати – для гральних закладів казино в місті Києві;
600 000 (шестистам тисячам) євро за офіційним курсом Національного банку України на день сплати – для гральних закладів казино в населеному пункті з чисельністю населення 500 тисяч осіб та більше;
300 000 (трьомстам тисяч) євро за офіційним курсом Національного банку України на день сплати – для гральних закладів казино в населеному пункті з чисельністю населення менше 500 тисяч осіб та поза межами населених пунктів.

The issue and holding of lotteries issued by the results of the competition carried out by the competent authority, in the manner prescribed by this law. The conditions of competition are established by the competent authority. The competition allowed legal entities that meet the following requirements: the proceedings for at least five years prior to submission of the issue or/and conducting lotteries; having international experience with the release and/or conduct lotteries at least three foreign countries; total turnover by 5 (five) financial years preceding the holding of the contest, is not less than 3 0000 0000 0000 (three billion) euros. BACKGROUND
